Selling alcohol online

GRADA sells alcohol online under Victorian liquor licence number 31960350, held by GRADA Group Holdings Pty Ltd (ACN 621 759 671), formerly Worksmith Coworking Pty Ltd. We sell and deliver within Australia only. We do not ship overseas.

Warning Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under 18 years (penalty exceeds $25,000) and for a person under 18 years to purchase or receive alcohol (penalty exceeds $1,000).

We support the responsible service of alcohol. We will not knowingly sell or supply alcohol to a person under 18 years of age, or to a person who appears intoxicated.

You must be 18 or over to buy from this site. When you place an order you confirm that you are 18 or over and that the person receiving the order is 18 or over. We may ask for proof of age before we accept an order, and we may refuse or cancel any order where age cannot be verified.

We cannot sell or deliver alcohol into a dry zone or restricted area. If your delivery address falls inside one, we will contact you and refund your order in full.

Ordering

When you place an order, you make an offer to purchase the products listed at the prices specified. The order is accepted once we send order confirmation by email and the goods are dispatched.

We may refuse or cancel an order before dispatch where:

• the product is out of stock
• age cannot be verified
• we suspect fraud or unauthorised use of a payment method
• the delivery address is in a dry zone or restricted area, or we cannot deliver there
• a law prohibits the sale or delivery

If we cancel an order you have paid for, we refund it in full.

Changing or cancelling your order

If your order has not been dispatched, we can change the delivery address or cancel it. Email drink@grada.au with your order number as soon as you can, and we will confirm by reply.

Once an order is on its way we can ask the carrier to redirect it, but that is not always possible and we cannot promise it.

Prices and payment

All prices on the site are in Australian dollars and include GST.

Payment is taken at the time of order. We accept the payment methods listed at checkout. Credit card details are processed by our payment provider over an encrypted connection. We do not store full card numbers on our servers.

We may change prices at any time. The price applicable to your order is the price displayed at the time you complete checkout.

Delivery

Our Shipping Policy forms part of these Terms. It sets out how we deliver, the age and ID checks on delivery, and that we never leave alcohol unattended.

Title and risk in the goods pass to you on delivery.

Returns, refunds and faulty goods

Our Refund Policy forms part of these Terms. It explains what to do if your order arrives damaged or faulty.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes those rights.

We do not accept returns of alcohol for change of mind. This does not affect your rights under the Australian Consumer Law if there is something wrong with the product.

Intellectual property

All content on this site, including the GRADA name, logo, product names, designs, text, images, video, and packaging, is owned by or licensed to GRADA and is protected by Australian and international intellectual property laws.

You may not reproduce, copy, distribute, sell, or commercially exploit any content on this site without our prior written consent. Personal, non-commercial viewing of the site is permitted.

Acceptable use

You agree not to:

• use the site for any unlawful purpose
• provide false personal or payment information
• attempt to circumvent age verification or other security features
• resell GRADA products purchased from this site without our written consent
• interfere with the operation of the site, scrape content, or introduce malicious code
• use the site to harass, abuse, or impersonate any person

We may suspend or terminate your access to the site for any breach of this clause.

Third-party links and platforms

The site may contain links to third-party websites or services that we do not control. We are not responsible for the content, accuracy, or practices of any third-party site. The hosting platform underlying this site may be operated by a third party; their terms and privacy practices apply to the hosting layer separately from these Terms.

Disclaimer and limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

• the site and its content are provided on an "as is" basis without warranties of any kind
• we do not warrant that the site will be uninterrupted, error free, or secure
• we are not liable for any indirect, incidental, special, or consequential loss, including lost profits, lost data, or loss of opportunity
• our total liability to you in respect of any claim arising out of or in connection with the site or any purchase is limited to the amount you paid for the relevant product

Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify GRADA, its directors, officers, employees, and agents against any loss, claim, damage, or expense (including reasonable legal costs) arising out of:

• your breach of these Terms
• your misuse of the site or our products
• your violation of any law or the rights of any third party

Privacy

Your use of this site and any personal information you provide is governed by our Privacy Policy.

Severability

If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.

Entire agreement

These Terms, together with our Shipping Policy, Refund Policy and Privacy Policy, constitute the entire agreement between you and GRADA in respect of your use of the site and any purchase. They supersede any prior agreement, representation, or understanding.

Governing law and jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You and GRADA submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia exercising jurisdiction in Victoria.
